Terms & Conditions of Service

1. Acceptance of Terms

By registering for an account, accessing, or using the services provided by Followup AI Inc. ("Followup AI", "we", "us", or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you are entering into this agreement on behalf of a company, partnership, or trade organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of the Service

Followup AI provides a cloud-based software application that helps trade professionals, contractors, remodelers, and service businesses track quotations, visualize proposal pipelines, and deliver automated, context-aware follow-up email sequences to their prospective clients. Features include quote status tracking, automated Day 3/7/14 email delivery, safety auto-stop triggers, and customer CRM tools.

3. User Accounts & Security

When creating an account, you agree to:

• Provide accurate, current, and complete business information.
• Maintain the confidentiality of your login credentials and passwords.
• Notify us immediately of any unauthorized use or security compromise of your account.
• Assume full responsibility for all activities conducted under your account.

4. Subscription Plans & Billing

Followup AI provides subscription plans structured on a monthly basis:

• Starter Plan ($19/month): Includes up to 500 automated follow-up emails per month, quote pipeline management, and standard deliverability.
• Growth Plan ($49/month): Includes up to 1,500 automated follow-up emails per month, AI tone customization, and CRM history.
• Business Plan ($99/month): Includes up to 4,000 automated follow-up emails per month, dedicated IP deliverability, custom domain authentication (SPF/DKIM), and priority support.

Subscription fees are billed automatically on a recurring monthly cycle. Unused monthly follow-up allowances do not roll over to subsequent months. You may cancel your subscription at any time through the Settings page; cancellations take effect at the conclusion of your current billing period.

5. Acceptable Use Policy

You agree not to use the Services to:

• Transmit unsolicited marketing messages, mass commercial spam, or phishing materials.
• Import purchased, scraped, or unverified email lead lists.
• Violate the CAN-SPAM Act, GDPR, TCPA, or any applicable regional communications laws.
• Attempt to reverse-engineer, decompile, or compromise the integrity of our software infrastructure.
• Impersonate any person, business, or trademark without authorization.

6. Intellectual Property & Client Data

Your Data: You retain all ownership, rights, and title to your quotations, customer records, pricing details, and client correspondence. You grant Followup AI a limited license solely to transmit and process this data to provide the Services.

Followup AI Property: Followup AI retains all rights, title, and interest in and to the software, branding, UI designs, codebases, algorithms, and documentation.

7. Service Availability & Disclaimers

While we strive for 99.9% application uptime and maintain premium email deliverability through certified infrastructure, the Services are provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee that every client will respond to or open sent follow-up emails, or that third-party recipient mail servers (e.g. Gmail, Outlook) will never filter messages to spam.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Followup AI Inc., its directors, employees, or partners be liable for any indirect, punitive, incidental, special, or consequential damages (including loss of profits, revenue, or business opportunities) arising out of or related to your use of the Services. In all cases, our total aggregate liability shall not exceed the amount paid by you to Followup AI during the three (3) months preceding the incident.
